Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Flowcus (“App”), a mobile application operated by Kazuma Nuno, an individual doing business as Flowcus (“we,” “us,” or “our”). By accessing or using our App, you agree to comply with these Terms. If you do not agree with these Terms, you should not use the App.

1. Access to the App

1.1 Eligibility

You must be at least 13 years old to use this App. If the laws in your country or region require a higher minimum age (or parental/guardian consent), you may use the App only if you meet those requirements. By using the App, you confirm that you meet all applicable age and consent requirements.

1.2 Registration and Account

To use the App, you must create an account. Access to most premium features, including video content, additionally requires an active paid subscription. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

1.3 Access Restrictions

We may suspend or terminate your account and access to the App at any time for reasons including, but not limited to, violation of these Terms or any applicable law.

2. Subscription and Payment

2.1 Subscription Plans

The App offers various subscription plans that grant access to premium features, including video content. Access to most premium content requires both a registered account and an active paid subscription. Some content may be made available to non-subscribed users at our discretion. Specific details, pricing, and duration of each plan will be displayed on the App.

2.2 Payment

Subscription fees are billed on a recurring basis (e.g., monthly or annually) unless canceled. Payments are processed through third-party payment providers (e.g., Apple, Google). You are responsible for providing accurate payment details.

2.3 Free Trials

From time to time, we may offer free trials. During the free trial period, you may access the App’s premium features at no charge. If you do not cancel before the trial ends, you will be charged according to the subscription plan you selected.

2.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellations will take effect at the end of your current billing cycle. We do not offer refunds directly except where required by applicable law or platform policy. Any refund requests or billing issues must be handled through the third-party payment provider, such as Apple (for iOS users). Please refer to their refund policies for more information.

3. Content and Intellectual Property

3.1 Definition of Content

All content provided through the App, including but not limited to videos, Tai Chi routines, choreographs, instructional materials, narrations, titles, descriptions, programs, and associated metadata (collectively, “Content”), is owned by Kazuma Nuno (doing business as Flowcus) or its licensors.

You may access and use the Content solely for personal, non-commercial use. You may not:

4. Health and Safety

4.1 Risk of Injury

By participating in Tai Chi routines and exercises presented in the App, you acknowledge and accept the inherent risks of physical activity. You are solely responsible for determining your physical ability to perform these exercises and should consult a healthcare professional before starting any new fitness program. To the fullest extent permitted by law, you release us from any liability, claims, or damages that may arise from injuries sustained while using the App.

5.1 Collection of Information

We collect and process personal information as described in our Privacy Policy. By using the App, you consent to such collection, use, and sharing of your information.

5.2 Data Security

We take reasonable measures to protect your personal information. However, we cannot guarantee the security of data transmitted through the App.

6. Disclaimers and Limitation of Liability

6.1 Disclaimer of Warranties

The App and all Content are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

6.2 Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of or inability to use the App.

You may terminate your account at any time by canceling your subscription and uninstalling the App.

7.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, for any reason, including violation of these Terms.

8. Governing Law and Dispute Resolution

8.1 Governing Law

These Terms are governed by the laws of Japan. Any disputes arising under these Terms will be resolved in the Tokyo District Court.

8.2 Dispute Resolution

We will attempt to resolve any disputes or claims through good-faith negotiation. If unsuccessful, disputes will be submitted to the Tokyo District Court as the court of first instance, unless otherwise required by applicable law.

10.1 Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on the App, and the “Effective Date” will be updated accordingly. Continued use of the App after changes indicates your acceptance of the revised Terms.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer your rights without our prior written consent.
